By accessing or using the PrepCompass (a product of Resilient Missions LLC) application and services ("PrepCompass"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Service.

PrepCompass provides a subscription-based emergency preparedness planning service that allows users to input household information, generate customized emergency preparedness plans, and receive guided support and preparedness coaching. 

PrepCompass uses a combination of rule-based logic and data-driven models, including artificial intelligence, to generate recommendations and guidance.

Outputs and recommendations may evolve over time as PrepCompass improves.

PrepCompass is available through monthly or annual subscription plans.

PrepCompass IS NOT A SUBSTITUTE FOR PROFESSIONAL EMERGENCY SERVICES.

• In case of an actual emergency, always call 911 or your local emergency services immediately

• Our Service provides general preparedness guidance and should not be relied upon as your sole source of emergency planning

• PrepCompass does not guarantee that following the provided plans will prevent injury, property damage, or loss during an emergency

• PrepCompass does not provide medical, legal, or engineering advice.

• Recommendations may be generated using artificial intelligence and may be incomplete, inaccurate, or not suitable for your specific circumstances.

• PrepCompass does not provide real-time emergency alerts or replace official alert systems.

• You acknowledge that emergency preparedness involves inherent risks and assume full responsibility for actions taken based on PrepCompass.

• Always consult with local authorities and emergency management professionals for specific guidance relevant to your area

4.1 Registration

To use our Service, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

4.2 Eligibility

You must be at least 18 years old to use this Service. By creating an account, you represent and warrant that you meet this age requirement.

5.1 Subscription Plans

We offer monthly and annual subscription plans. Your subscription will automatically renew unless cancelled before the renewal date.

5.2 Payment Processing

All payments are processed securely through Stripe, a third-party payment processor. We do not store your credit card or payment information on our servers. By providing payment information, you agree to Stripe's terms of service and privacy policy.

5.3 Billing

You authorize us to charge your selected payment method for the subscription fee at the beginning of each billing cycle.

5.4 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. No refunds will be provided for partial billing periods.

5.5 Price Changes

We reserve the right to modify subscription prices with 30 days' notice. Continued use of PrepCompass after price changes constitutes acceptance of the new pricing.

6.1 Your Information

You retain ownership of all household information and data you provide to PrepCompass ("User Content"). By submitting User Content, you grant PrepCompass a non-exclusive, worldwide, royalty-free license to use, process, and store this information solely for the purpose of providing PrepCompass to you.

You represent that you have the authority to provide and share information about members of your household.

6.2 Accuracy

You are responsible for ensuring that all information you provide is accurate and up-to-date. Inaccurate information may result in ineffective emergency plans.

PrepCompass is designed to evolve over time. As we improve our methodologies, data models, and recommendation engines:

• Your preparedness assessments, scores, and recommendations may change

• Changes do not necessarily reflect a decline in preparedness

• We do not guarantee consistency of outputs across versions

PrepCompass may suggest supplies or preparedness-related items based on your household profile.

• These recommendations are intended to support preparedness

• They are not advertisements based on third-party data

• You are responsible for evaluating whether recommendations are appropriate

• We may include optional links to third-party products or services.

PrepCompass may allow you to share information with trusted individuals.

• You control what is shared and with whom

• You may revoke access at any time

• PrepCompass is not responsible for how recipients use or retain information once accessed

• Any sharing is done at your own discretion and risk.

10.1 Privacy Policy

Your use of our Service is also governed by our Privacy Policy, which details how we collect, use, and protect your information.

10.2 California Privacy Rights (CCPA)

If you are a California resident, you have specific rights under the California Consumer Privacy Act (CCPA), including:

• The right to know what personal information we collect, use, and disclose

• The right to request deletion of your personal information

• The right to opt-out of the sale of personal information (note: we do not sell personal information)

• The right to non-discrimination for exercising your privacy rights

11.1 Our Property

All content, features, and functionality of PrepCompass, including but not limited to text, graphics, logos, and software, are owned by PrepCompass and protected by intellectual property laws.

11.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use PrepCompass for personal, non-commercial purposes.

You agree not to:

• Use PrepCompass for any unlawful purpose

• Share your account credentials with others

• Attempt to gain unauthorized access to our systems

• Reverse engineer or attempt to extract the source code of our software

• Use PrepCompass to generate plans for illegal activities

• Resell or commercially distribute plans generated by PrepCompass

• Input false or misleading information

• Use automated systems or software to extract data from PrepCompass

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• PREPCOMPASS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES

• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR PrepCompass IN THE 12 MONTHS PRECEDING THE CLAIM

• WE ARE NOT LIABLE FOR ANY DAMAGES OR LOSSES RESULTING FROM EMERGENCIES, DISASTERS, OR YOUR RELIANCE ON PrepCompass

• PREPCOMPASS IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND

• THIS LIMITATION APPLIES TO ANY CLAIMS ARISING FROM AI-GENERATED OUTPUTS, RECOMMENDATIONS, OR THIRD-PARTY INTEGRATIONS.

You agree to indemnify and hold harmless PrepCompass, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of PrepCompass or violation of these Terms.

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through PrepCompass. Continued use of PrepCompass after changes constitutes acceptance of the modified Terms.

PrepCompass is not liable for delays or failures caused by events beyond our control, including natural disasters, outages, or infrastructure failures.

We may terminate or suspend your account immediately, without prior notice, for:

• Breach of these Terms

• Fraudulent or illegal activity

• Non-payment of subscription fees

• Any action that may harm PrepCompass or other users

These Terms shall be governed by the laws of Oregon, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Washington County, OR.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PrepCompass regarding the use of our Service.
